Collective Bargaining & Disputes

Collective bargaining enables employees who are union members to negotiate with their employers to determine their terms of employment, including pay, benefits, hours, annual leave, pension provisions etc.

Sometimes, but not always, there is a collective bargaining agreement in force between the employer and union members which may mean that both parties negotiate on an annual basis, particularly on pay issues.

There is no statutory union recognition in Guernsey. Nevertheless, negotiations between employer and employee representatives are to be encouraged in order to reach agreement.

If negotiations are unsuccessful, either party can refer the matter to the Industrial Disputes Officer who will meet with the parties, understand the issues involved and ultimately determine whether a dispute is suitable for acceptance under The Industrial Disputes and Conditions of Employment (Guernsey) Law, 1993. The law allows for disputes to be referred, through the Industrial Disputes Officer, for resolution by a third party, voluntarily by conciliation or arbitration or ultimately by a compulsory independent Industrial Tribunal.
