Intellectual Property in Guernsey
Intellectual Property legislation enables a first registration of Trade Marks in the Bailiwick via the Intellectual Property Office. Trade Marks registered in the UK, Europe or under the Madrid International System can also be registered at the Bailiwick Office.
Trade Marks registered under the 1922 legislation will be carried forward as a vaild registration under the 2006 legislation.
Registered Design remains a re-registration process - re-registrations can be accepted from 29 jurisdictions as well as The Office of Harmonization for the Internal Market (OHIM). New designs registrations that have sucessfully completed the applicaiton process are published under the Official Publications section of this website (below).
The Patent legislation is currently progressing through the drafting process. Until the new Patents legislation is passed, the existing arrangements for re-registering Patents via the Court and Greffe will continue.
