In pursuance of the provisions of the proviso to Article 66(3) of the Reform (Guernsey) Law, 1948, as amended, "The Public Transport (Amendment) Ordinance, 2016", made by the Legislation Select Committee on the 25th April, 2016, is laid before the States.
This proposition has been submitted to Her Majesty's Procureur for advice on any legal or constitutional implications in accordance with Rule 4(1) of the Rules of Procedure of the States of Deliberation and their Committees.
EXPLANATORY MEMORANDUM
This Ordinance is made under sections 3 and 6 of the Public Transport (Guernsey) Law, 1984 and amends the Public Transport Ordinance, 1986 ("the 1986 Ordinance").
The purpose of this Ordinance is to clarify the legislative position in respect of road train vehicles and services under the 1986 Ordinance by inserting a provision into the 1986 Ordinance to ensure that a road train vehicle falls within the definition of "motor vehicle".
The Ordinance was made by the Legislation Select Committee in exercise of its powers under Article 66(3) of the Reform (Guernsey) Law, 1948, and came into force on the 26th April, 2016. Under the proviso to Article 66(3) of the Reform (Guernsey) Law, 1948, the States of Deliberation have the power to annul the Ordinance.
