Tuesday 10 December 2019

At the November 2019 States Meeting, the States of Deliberation passed The Environmental Pollution (Air Pollution) Ordinance, 2019.

This provides the Office of Environmental Health and Pollution Regulation with powers to deal with air pollution locally, introducing air quality standards and objectives, a licensing system for certain operations which have emissions to the air and new controls over open burning (bonfires).

The Ordinance came into force on Monday 2nd December and so guidance has been issued at www.gov.gg/pollution to help members of the community understand what it means for them. Elements of the legislation cover bonfires and as a result, the guidance provides information on what can be burned as well as how and where is may be burned.

Certain operations which involve the release of emissions into the atmosphere are considered to be prescribed operations, and require a licence. This can include paint spraying operations, dry cleaners, new or large-scale petrol dispensing stations, operations with large-boilers or furnaces and the power station. If you think that your business may require a licence, please contact the Office of Environmental Health and Pollution Regulation (OEHPR) as soon as possible by emailing envhealth@gov.gg or by calling 711161. The OEHPR will also be contacting businesses that are likely to require a licence.

A full copy of the Ordinance can be found online at www.guernseylegalresources.gg.
