Admiral Park Planning Application - Reference OP/2012/0143 for Erection of residential, office, retail, hotel and leisure facilities at various sites off Elizabeth Avenue, Admiral Park, Les Banques, St. Peter Port for Comprop (C.I.) Limited

The Environment Board at its meeting on 11December 2012 resolved that the Outline Planning Brief for Le Bouet Mixed Use Redevelopment Area has expired by virtue of section 13 of the Land Planning and Development (Plans) Ordinance, 2007. This provides that a Local Planning Brief has effect for 10 years from its date of adoption by the States unless extended by resolution of the States. The Board consider it has expired as it was adopted more than 10 years ago and has not been extended by resolution of the States. In view of this the above planning application will now be determined having regard to the Urban Area Plan but not the expired Outline Planning Brief.

The Department has therefore invited the applicants to submit a revised planning statement in view of the Department's decision on the OPB. This is to give the applicant, in the interests of fairness, the opportunity to comment on the Urban Area Plan policies not taking into account the OPB. If the applicant accepts this invitation, and a revised statement is submitted, it will be publicised for public comment in the normal way prior to the determination of the application. This will provide an opportunity for the public, in the interests of a fair process, to comment on the revised planning statement in the usual way.
