Could you see if anyone is available to interview today or if you could provide a statement to the following:
The Senior Constable of St Martin says there should be a time limit once planning permission has been granted, so for example if permission is approved then the applicant has 2 years to commence development.
Could you please let me know what the current situation is and if there is no time-limit whether the department agrees with the Senior Constables views or not.
Environment Department Response:
Planning permissions granted by the Environment Department as the Island's planning authority are normally subject to the following standard condition:-
"The development hereby permitted shall be begun within 3 years from the date of grant of this permission.
Reason - This condition reflects section 18(1) of the Land Planning and Development (Guernsey) Law, 2005 which states that planning permission ceases to have effect unless development is commenced within 3 years of the date of grant (or such shorter period as may be specified in the permission)."
